Terms of service

The Crashform service, payment and subscription rules, and your legal rights.

1. Provider and scope

Crashform is provided by [JURIDISCHE NAAM], [REGISTERED ADDRESS]. Contact [CONTACTMAIL] for questions, complaints and withdrawal. The business registration number still needs to be added. This working version describes the service for individuals and organisations. Separately agreed business terms take precedence for their subject matter; mandatory legal rights remain.

2. The service

Crashform helps document an accident, review details with another party, sign electronically and generate a sealed PDF. Reports may be joint, one-sided or for a single vehicle. The personal back page is a separate statement for one party.

Crashform is not an insurer, emergency service or claims assessor. It does not determine liability or automatically submit an insurance or police claim. Follow legal reporting duties, your policy and competent authorities’ instructions. Contact emergency services in immediate danger.

3. Completing, reviewing and signing

Enter information truthfully and identify uncertainty. Act for someone else only when authorised or when the flow expressly records that you are completing known or unknown details about a non-participating party. A one-sided report does not represent that party’s agreement.

Review the document before signing. The stored signature and hash help record what was signed. Crashform does not provide a qualified electronic signature or guarantee acceptance by every insurer or authority. Legal assessment depends on the facts and applicable law.

4. Access and safe use

Keep device keys, invitations and personal links secure. Personal and download links can grant document access, so share them only with authorised people. A report code can reveal signers’ names and timestamps on the verification page.

Do not use the service for deception, unauthorised access, harmful files or unnecessary collection of others’ information. Security measures, including rate limits, may temporarily block requests. Suspected misuse may lead to restricted access and investigation, with explanation and an opportunity to contact us where possible.

5. Individual report pricing and payment

Price, currency and applicable tax are shown before payment in the app and Checkout. Region and IP country may determine price and currency. Contact us before paying if the displayed country or amount is wrong.

The front page is purchased once for both parties. An optional personal back page is purchased separately for that party; the other party may buy their own. For new payable reports, completion, review and signing are available before payment. PDF downloads are released after backend-confirmed payment. A notification that the PDF is ready is not payment confirmation.

Stripe processes payment. Returning from Checkout alone does not grant access. For duplicate charges or missing paid access, email the report code and payment reference without sending full card details.

6. Business subscriptions

The selected package, capacity, price, currency and taxes appear before payment. Billing is monthly and renews according to the selected Stripe subscription. Capacity includes the package allowance and selected additional vehicles.

Cancellation is managed through the billing portal. Current settings cancel at the end of the paid period. New business reports require a server-confirmed active paid subscription. Follow billing instructions if payment fails; applicable legal rights remain.

The organisation is responsible for authorised administrators, profile information, internal access and lawful handling of employee or driver information. Separate processing terms are needed where Crashform acts as a processor; these service terms do not replace them.

7. Availability and your own copy

A report and its personal back pages are available until seven days after the report is created. After that deadline the report and its files are automatically deleted by a job running every fifteen minutes, processing large volumes in batches. Download your PDF before the deadline and keep it securely. Crashform does not provide long-term archiving.

Maintenance, outages or third-party dependencies may affect availability. Report problems through the contact address. Statutory remedies for a non-conforming or undelivered service remain.

8. Withdrawal and remedies

Where consumer law provides a cooling-off period, you may use it; for online services in the EU this is generally fourteen days from contracting. Email [CONTACTMAIL] with your name, purchase date and report or payment reference and state that you wish to withdraw.

Opening or downloading a PDF is not itself a waiver relied upon by Crashform. In this version we do not rely on loss of withdrawal rights without the legally required prior consent, acknowledgement and confirmation. Valid withdrawal, refunds and further handling follow applicable law. Rights concerning defects or wrong delivery are unaffected.

Business customers do not automatically have statutory consumer cooling-off rights. Their agreed subscription and cancellation rules apply alongside other legal remedies.

9. Personal information and documents

The privacy notice explains information processing, purposes and recipients. Include only information needed for the accident and its concrete handling, and ensure you may lawfully provide others’ information.

Your report and uploads remain your case material. We may process, store and convert them into documents and provide them to authorised parties to deliver the service. This does not grant general permission to publish the report or use it for advertising.

10. Legal remedies and liability

Applicable statutory remedies govern failures to provide the service. This working version introduces no general monetary liability cap and does not waive mandatory consumer rights. A hash cannot make incorrect information or a user’s incorrect conclusion accurate.

Rules on liability, evidence, privacy, insurance and jurisdiction depend on the circumstances. Obtain appropriate professional assistance for important or disputed reports.

11. Complaints, law and changes

Email [CONTACTMAIL] with the relevant report or payment reference and describe the problem. We assess the complaint and provide a substantive response; technical problems may require additional information.

Applicable law and competent courts are determined by statutory rules. This working version makes no alternative contractual choice of law or court. Mandatory consumer protection in the consumer’s country continues where required by law.

A new version does not apply retroactively to a completed purchase. Material changes to an existing business agreement are communicated in advance, preserving applicable statutory and agreed cancellation rights.
